Focolare Movement of the US and Canada Privacy Policy for Online Donation (July 1, 2021)
1. TWO PRIVACY POLICIES. The Focolare Movement of the US and Canada ("FMNA") is a customer of Trail Software, Inc. ("Trail"), which provides the Kindful donation management system ("Kindful System") described in the Trail Software, Inc., Privacy Policy ("TSPP") posted separately. Trail and FMNA are separate legal entities. TSPP and the Focolare Movement of the US and Canada Privacy Policy for Online Donation ("FDPP") are both applicable to your use of Kindful System. You shall be responsible for reviewing and becoming familiar with both TSPP and the FDPP.
2. PERSONAL INFORMATION. “Personal information” means information about a specific individual who can be directly or indirectly identified using that information, which does not include aggregate or anonymous information that cannot identify a specific individual or individuals.
3. CONSENT. BY SUBMITTING YOUR PERSONAL INFORMATION TO FMNA THROUGH THE KINDFUL SYSTEM, YOU CONSENT TO THE FDPP AND TO THE FMNA'S COLLECTION, USE, AND DISCLOSURE OF YOUR PERSONAL INFORMATION ACCORDING TO THE TERMS OF THE FOCOLARE PRIVACY POLICY. FMNA DOES NOT KNOWINGLY COLLECT INFORMATION FROM PERSONS UNDER 13 YEARS OF AGE THROUGH THE KINDFUL SYSTEM. IF YOU ARE UNDER 13 YEARS OF AGE, YOU MAY NOT USE THE KINDFUL SYSTEM TO DONATE TO FMNA.
4. US AND CANADA ONLY. The Kindful System is available for the use of the residents of the United States and Canada only. Residents of other countries are required to donate to the Focolare Movement in their own countries.
5. POLICY. The FDPP describes how FMNA collects, uses and shares personal information of those using the Kindful System to donate to FMNA. The FDPP does not apply to websites that post different privacy statements.
6. INFORMATION COLLECTED. When you make a donation using the Kindful System, FMNA collects information that you voluntarily enter into the Kindful System, which may include your name, postal address, email address, phone number, and the amount and date of your donation. FMNA may obtain information about you from other sources. FMNA may add this to information you provide to us.
7. USES OF PERSONAL INFORMATION. FMNA uses your personal information for the following purposes:
a. to provide information to you for tax purposes
b. to respond to your comments and questions and provide customer service
c. to send information to you, including confirmations, technical notices, updates, security alerts, and support and administrative messages
d. to communicate with you about the uses of your donation
e. to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity
f. for internal financial uses of the FMNA, including accounting, planning and budgeting of FMNA, including entry into other software applications used by FMNA for its internal financial affairs
8. SHARING PERSONAL INFORMATION. FMNA may share your personal information with others in the following circumstances:
a. for legal, protection, and safety purposes
b. to comply with applicable laws and regulations
c. to respond to lawful requests and legal process
d. to protect the rights and property of FMNA, our agents, members, and others, which includes enforcing our agreements and policies
e. when necessary in an emergency, including protecting the safety of our employees and agents, our members, or any person
f. when it is needed by vendors and contractors for work directly related to providing and improving the donation process using the Kindful System
9. MARKETING. FMNA does not sell, trade, or share personal information with other organizations except as provided in Section 8 of the Focolare Privacy Policy. FMNA does not disclose the personal information of donors to third parties for direct marketing purposes.
10. SECURITY. We take steps to help protect your personal information. However, no organization can fully prevent security risks. Mistakes may happen. Bad actors may defeat even the best safeguards. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to us is done at your own risk.
11. ACCESSING AND CHANGING YOUR PERSONAL INFORMATION. You may obtain information about and request changes to your personal information by contacting FMNA at this email address: na-zonecenters-red@focolare.us. You may send comments and feedback about the Focolare Privacy Policy to the same address.
12. CHANGES TO THE FDPP. FNMA reserves the right, at its sole discretion, to modify or replace the FDPP at any time. If the modifications constitute a material change to the FDPP, FMNA will notify by email donors who have used the Kindful System. What constitutes a material change will be determined at FMNA's sole discretion. You shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Kindful System or viewing any content on the Kindful System following notification of a material change shall constitute your acceptance of the FDPP as modified. The FDPP was last updated on July 1, 2021.
